Terms & Conditions of Carriage

1. Commercial Entity & Contract Formation

These Terms and Conditions of Carriage ("Terms") constitute a legally binding electronic contract between the passenger or booking entity ("Client", "Guest", "You") and Anil Tours & Travels (Sole Proprietorship: Anil Kumar, established 1995, with Central Operations at Sector 5, Mansarovar / MI Road, Jaipur, Rajasthan 302020; hereinafter referred to as "Anil Tours", "We", "Us").

A binding contract is formed upon the occurrence of any of the following: (a) payment of an advance booking deposit, (b) receipt of written booking confirmation via WhatsApp or email from our central dispatch desk, or (c) passenger boarding of our allocated vehicle.

2. Chauffeur Carriage & Vehicle Allocation

Anil Tours operates a fleet of commercial passenger vehicles holding valid All-India Tourist Permits (AITP) or state commercial permits. Every booking is provided exclusively as a chauffeur-driven service; self-drive rentals are strictly prohibited.

We reserve the right to upgrade vehicle tiers at no additional charge in the event of unexpected logistics or mechanical requirements. In all cases, passenger capacity standards (e.g. Sedan 4+1, Innova Crysta 6+1/7+1, Force Urbania 16+1, Tempo Traveller 12/17/26 seats) must be strictly respected. Overcrowding beyond licensed seating limits is a statutory violation and will result in refusal of boarding.

3. Tariffs, Tolls, State Taxes & Commercial Billing Rules

• Outstation Minimum Running: A minimum running of 250 kms per calendar day will be charged in outstation rentals.
• Metering Standards by Trip Type: Prepaid fixed one-way intercity drops and airport transfers feature 100% doorstep-to-doorstep billing with zero garage deadhead. Local city charters and open per-km outstation rentals are calculated from garage to garage basis within designated municipal zones.
• Driver DA / TA: Driver DA / TA is applicable on all outstation journeys, and on local packages for duty extending after 9:00 PM.
• Minimum Local Package: A minimum 12 Hours / 120 Kms package applies for full-day local city rentals, and on all high-season dates.
• Hill Terrain Guarantee: 100% Hill-Climb AC Guarantee across Aravalli and Mount Abu ghat sectors with zero hidden hill surcharge.
• Taxes, Tolls & Commercial Billing: For prepaid one-way drops, highway FASTag tolls and state border permits are bundled upfront. For local 12h/120km charters and round-trip rentals, toll taxes, municipal parking fees, interstate passenger entry taxes, and statutory 5% GST are billed at actual electronic receipts.
• Regional Tariff Baseline: Published standard tariffs apply to Jaipur HQ and regional depot dispatches (Delhi NCR, Udaipur, Mount Abu). Customized multi-city itineraries are confirmed transparently via our 24/7 dispatch desk.
• Tax Credentials & Commercial Invoice: All applicable taxes (including Goods and Services Tax - GST) and statutory GSTIN registration credentials are systematically disclosed during commercial billing over official invoices provided upon trip completion.

4. Passenger Code of Conduct & Interstate Contraband Disclaimers

To guarantee the safety of passengers, chauffeurs, and vehicles, passengers must adhere to standard carriage decorum:

• Zero Smoking & Narcotics Policy: Smoking, tobacco consumption, and the possession or consumption of narcotics, psychotropic substances, or unlawful goods inside any vehicle are strictly forbidden.
• Interstate Dry-State Prohibition Notice (Gujarat Transit): Under the Gujarat Prohibition Act, 1949, the state of Gujarat enforces total alcohol prohibition. On routes entering or transiting Gujarat (including Ahmedabad, Surat, Vadodara, or Abu Road border points), passengers are strictly prohibited from carrying, transporting, or consuming alcoholic beverages in any quantity. The passenger shall be solely and personally liable for any criminal proceedings, fines, or confiscations arising from a breach of dry-state laws.
• Respectful Conduct: Chauffeurs reserve the right to immediately terminate service and drop passengers at the nearest public location or police station if passengers engage in abusive, disorderly, violent, or unlawful conduct.

5. Luggage Liability & Lost Property

Luggage and personal effects are carried entirely at passenger risk. Chauffeurs will assist with loading and unloading, but Anil Tours accepts no liability for lost, stolen, or damaged personal valuables, cash, jewelry, laptops, cameras, or fragile glassware.

Items left behind in vehicles will be deposited at the nearest regional depot (Jaipur, Delhi, Udaipur, Mount Abu) and retained for 30 days. Courier costs for returning lost articles must be borne by the passenger.

6. Limitation of Liability & Force Majeure

While Anil Tours maintains a 99.2% on-time record, unforeseen road and mechanical conditions can occur:

• Exclusion of Consequential Losses: Anil Tours shall not be liable for any indirect, incidental, or consequential damages, including missed domestic or international flights (such as flights from Delhi IGI Airport T3 or Jaipur Airport), missed train departures, hotel forfeiture, or missed business/wedding functions resulting from road traffic jams, expressway accidents, vehicular tyre punctures, mechanical issues, bad weather, or police diversions.
• Breakdown Replacement Commitment: In the event of a mechanical breakdown en route, our central dispatch will mobilize a replacement vehicle from the closest operational hub within 60 to 90 minutes.
• Force Majeure: Anil Tours is exempt from contractual performance obligations in events of Force Majeure, including floods, hill landslides on Mount Abu ghats, civil unrest, bandhs, state border blockages, government VIP movement restrictions, or acts of God.

7. Third-Party Trademarks (Nominative Fair Use)

All automotive manufacturer brand names, logos, and model designations (such as Toyota, Innova Crysta, Innova Hycross, Fortuner, Camry, Force Urbania, Tempo Traveller, Mercedes-Benz, Volvo, Scania, Maruti Suzuki Dzire, and others) displayed on this website are the registered trademarks of their respective proprietors. Anil Tours & Travels operates as an independent commercial mobility enterprise and references these trademarks solely for descriptive vehicle identification under the doctrine of nominative fair use (Section 30 of the Trade Marks Act, 1999). No affiliation, endorsement, or sponsorship is implied.

8. Governing Law & Exclusive Jurisdiction

These Terms and all transportation contracts executed by Anil Tours & Travels shall be governed by and construed in accordance with the laws of the Republic of India. In the event of any dispute, controversy, or claim arising out of or relating to these terms or services provided, the competent courts in Jaipur, Rajasthan, India shall have sole and exclusive territorial jurisdiction.
